Petitioner seeks bail in Wazirganj P.S. Case No. 239 of 2017 for the offences punishable under Sections 392 of the Indian Penal Code.

Informant has alleged in his written complaint that on 08.06.2017, when he was coming on motorcycle three unknown persons accompanied him on the pretext that mother and brother have received some injury in the accident and therefore, he may drop them to their house and thereafter informant gave the key of motorcycle to one of them and asked to ride the motorcycle and in midway three unknown persons ran away with the motorcycle. The name of the petitioner had transpired in the confessional statement of co-accused Mantu Kumar and the stolen motorcycle has been recovered from the house of the

Patna High Court Cr.Misc. No.52402 of 2017(2) dt.09-11-2017 2/2 petitioner.

It has been submitted on behalf of the petitioner that the petitioner has been falsely implicated in this case. Petitioner has got no criminal antecedent and is in custody since, 09.07.2017.

Learned APP for the State opposes the prayer for bail. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Gaya in connection with Wazirganj P.S. Case No. 239 of 2017.
