JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 12-01-2023 The learned counsel for the petitioner is directed to remove all the defects pointed out by the office within one month. Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Chausa P.S. Case No. 25 of 2022 registered for offence punishable under sections 406, 420/34 of the Indian Penal Code. As per allegation, there is allegation that co-accused Md. Nasim Ansari and the petitioner, who is the father of Md. Nasim Ansari, were engaged in business of maize and they have taken maize worth Rs.9,10,000/-, from the farmers including the informant, but they did not make payment to them. The learned counsel for the petitioner has submitted that Md. Nasim Ansari is engaged in business of maize and the

Patna High Court CR. MISC. No.44337 of 2022(3) dt.12-01-2023 2/2 petitioner has falsely been implicated, since he is the father of main accused Md. Nasim Ansari. He has submitted further that Md. Nasim Ansari is under custody since February, 2022. He has also submitted that the witnesses in paragraph nos. 28 and 29 of the case diary, have stated that the petitioner resides separately, having no concern with his son.

On the other hand, the learned APP opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Udakishunganj, Madhepura in connection with Chausa P.S. Case No. 25 of 2022, subject to condition as laid down under section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
