JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-11-2018 The petitioner seeks regular bail in connection with Vibhutipur P.S. Case No. 08/2017 corresponding to Sessions Trial No. 460/2017, registered for offences punishable under Section 304B and 34 of the Indian Penal Code. Allegation against petitioner is of causing dowry death. He happens to be the husband of deceased. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case. The real fact is that she was issueless and committed suicide. Her dead-body was found inside the house of petitioner. He further submits that as per post-mortem report the cause of death is asphyxia caused by mechanical obstruction of respiratory airway resulting from throttling. He is in custody since 17.04.2017. Heard learned A.P.P. also.
Patna High Court Cr.Misc. No.63543 of 2018(3) dt.20-11-2018 2/2 Having heard both sides, in view of the facts as stated above, I am not inclined to grant bail to the petitioner abovenamed. Taking into consideration the fact that petitioner is in custody for more than six months, the trial court is directed to hold the trial on day-to-day basis and conclude the same expeditiously.
