The petitioner is in custody in connection with Nayagaon P.S.Case No.107 of 2017 registered for an offence under Sections 399, 402 and 414 of the IPC.

On getting secret information, the police party visited at the spot and apprehended the petitioner and six others who had assembled to commit some crime. The police party seized one mobile phone from the possession of this petitioner and fire arm and a motorcycle from the possession of other co-accuseds. It has been submitted that the petitioner is in custody since 03.11.2017 having clean antecedent. The learned counsel further submits that similarly situated co-accused Pravin Kumar @ Ghosh and Hemant Kumar Singh have been allowed bail by this

Patna High Court Cr.Misc. No.63025 of 2017 (2) dt.11-01-2018 2/2 Court in Cr.Misc.No.61821 of 2017 and Cr.Misc.No.60602 of 2017 respectively. The case of this petitioner stands on better footing as no incriminating article has been recovered from his possession.

Learned APP opposed the submissions.

In the facts and circumstances of the case, prayer for bail is allowed. Let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM, Saran at Chapra in connection with Nayagaon P.S.Case No.107 of 2017.
