The petitioner seeks bail in Riga P.S. Case No. 176 of 2017 registered under Section 363 & 366 A of the Indian Penal Code.

As per the prosecution case, the petitioner along with three other accused persons are said to have kidnapped the minor daughter of the informant.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in this case. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. The petitioner happens to be lady. The victim in her statement under Section 164 Cr.P.C. has

Patna High Court Cr.Misc. No.60804 of 2017 (03) dt.02-02-2018 - 2 - candidly stated that she was not kidnapped by anyone rather she went to the house of her Phupha (uncle) out of her sweet will. The petitioner has been languishing in custody since 07.09.2017. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Riga P.S. Case No.176 of 2017.
