Agrawal, learned senior counsel assisted by Mr. Ashok Kumar Jha, learned counsel for the petitioners, learned counsel for the informant and learned A.P.P. for the State.
The petitioners seek bail in connection with Riga P.S. Case No. 213 of 2020 registered for the offences punishable under Sections 341, 323, 307, 379, 454/34 of the Indian Penal Code and later on Section 302 of I.P.C. was added. The informant Neelam Devi submitted a written report to the S.H.O. of Riga Police Station stating that on the date of occurrence, the accused Nand Kishore Sah, her next door neighbour and his wife, sons Sanjay Kumar Sah, Vikay
Patna High Court CR. MISC. No.934 of 2021(3) dt.05-04-2021 2/3 Kumar, Dhananjay Kumar, Manjay Kumar, Ranjan Kumar, Vivek Kumar, along with others entered into hr house in the night which was objected then they having danda, rod bricks and farsa in their respective hands assaulted her father-in-law, mother-in-law, dewers, who sustained injury and thereafter, they snatched the Mangalsutra and nose pin from the mother-in-law of the informant.
Learned senior counsel for the petitioners submits that the petitioners have falsely been implicated in the present case. There is general and omnibus allegation against the petitioners. He further submits that the doctor found the injuries to be simple in nature. During the treatment, the father-in-law of the informant, namely, Hans Raj Sah was examined at Primary Health Center, Riga on 25.07.2020 in the night at 11:30 p.m. and the doctor treat ing him at Primary Health Center found the injury upon his person to be simple in nature and tehre is no opinion of the doctor on the injury report regarding better treatment required by the injured Hans Raj Sah. After two months i.e. on 28.09.2020, father-in-law of the injured namely, Hans Raj Sah died. Learned senior counsel for the petitioners further submits that there is no specific overt act against the petitioners. Petitioners are in jail custody since 16.08.2020 and

In the facts and circumstances of the case, let the above named petitioners be enlarged on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) each only with two sureties of the like amount each to the satisfaction of learned C.J.M., Sitamarhi in connection with Riga P.S. Case No. 213 of 2020.
