JUSTICE BIRENDRA KUMAR ORAL ORDER 28-11-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 323,498(A) of the Indian Penal Code.

Petitioner is husband of opposite party No.2. Allegation is of torture to opposite party No.2. The mediation could not materialize as petitioner did not appear before the Mediator of the Patna High Court.

Considering the facts of this case, in my view, this is not a fit case for grant of anticipatory bail. Hence, prayer is refused in connection with Complaint Case No.1642(C) of

Patna High Court CR. MISC. No.43177 of 2019(5) dt.28-11-2019 2/2 2018 pending in the court of learned Judicial Magistrate 1st Class, Araria.

Petitioner may surrender and pray for regular bail.
