The petitioner apprehends his arrest in Singheshwar P.S. Case No.149 of 2021 registered under Sections 30(a) and 41(i) of the Bihar Prohibition and Excise Act and 120B of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. It is further submitted that nothing has been recovered from possession of the petitioner. The alleged recovery has been made from the truck. The petitioner has got no criminal antecedent. Learned A.P.P. for the State has opposed the prayer for bail by contending that the petitioner is the owner of the petrol pump. There is specific allegation against this petitioner that he in collusion with other accused persons run the business of

The petitioner is also alleged to have got the truck parked at his petrol pump, from where the distribution of illicit liquor is made to different place. Therefore, the petitioner does not deserve anticipatory bail. Having considered the facts aforesaid, this Court is not inclined to enlarge the petitioner on anticipatory bail.
