JUSTICE RAVI RANJAN ORAL ORDER 19-01-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 341, 323, 324, 307, 379/34 of the Indian Penal Code.
It is contended on behalf of the petitioner that both the sides, i.e., the informant and the petitioner, are agnates and there is land dispute between both the parties. It is further contended that, as per the allegation, the petitioner has given repeated "farsa" blow, however, there is only injury caused by sharp cutting weapon on the head which is simple in nature. So far other injury on the informant is concerned that has been caused by hard and blunt substance and one of them is grievous but that cannot be attributed against the petitioner. Having regard to the facts and circumstances of the case, let the petitioner, namely, Sunil Kumar Verma @ Sunil Verma be released on bail in the event of his arrest/surrender before the court below within a period of six weeks from today in connection with Bhorey P.S. Case No.168/2015, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate1st Class, Gopalganj subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
