ABHISHEK REDDY ORAL ORDER 03-10-2023 Learned counsel for the petitioner states that the Divisional Commissioner without going into the merits or demerits of the case has dismissed the revision filed by the petitioner solely on the ground that the revision is hit by period of limitation. Learned counsel states that the order may be set aside and the matter remanded back to the authority concerned and that he will file an appropriate application seeking condonation of delay for filing the revision beyond the period of limitation.

Having regard to the above made submissions, the impugned order is set aside and the matter is remanded back to

Patna High Court CWJC No.10035 of 2023(2) dt.03-10-2023 2/2 the authority concerned. Learned counsel for the petitioner is directed to file an application seeking condonation of delay in filing the revision within a period of four weeks from today. On filing the said condonation delay petition, the authority concerned shall consider the said application and thereafter dispose of the revision on merits.
