Heard learned counsel for the Petitioners and the State.
The Petitioners apprehend their arrest in Punpun P.S. Case No.233 of 2015 instituted for the offence under Section(s) 498-A, 304-B/34 Indian Penal Code. It has been submitted on behalf of the petitioners that these petitioners are the family members of the husband of the deceased. There is general and omnibus allegation against
Patna High Court Cr.Misc. No.47119 of 2016 (4) dt.27-03-2017 2/2 these petitioners. It has been submitted that one of the co-accused with similar allegation has been granted anticipatory bail by a coordinate Bench of this Court by order dated 22.08.2016 passed in Cr. Misc. No.21549 of 2016.
As per written report, sister of the informant was killed for non-fulfillment of demand of dowry within one year. From perusal of the case diary, it appears that there is general and omnibus allegation against these petitioners, who are family members of the husband of the deceased. It is mentioned in para 3 of the petition that the petitioners have no criminal antecedents.
In the facts and circumstances of the case, prayer of the petitioners for grant of anticipatory bail is allowed. In the event of surrender/arrest of the petitioners, named above, within six weeks from today in connection with Punpun P.S. Case No.233 of 2015, they shall be released on anticipatory bail on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st class, Masuarhi, subject to the conditions as laid down under Section 438(2) Cr. P. C.
