JUSTICE MADHURESH PRASAD ORAL ORDER 12-12-2017 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This is a case registered for the offence punishable under Sections 302 and 201/34 of the Indian Penal Code.
It is submitted on behalf of the petitioner that though he is not named accused in the First Information Report, his name has surfaced in the case on the basis of the statement of one witness, who has alleged to have
Patna High Court Cr.Misc. No.55609 of 2017 (2) dt.12-12-2017 2/3 last seen the petitioner with the deceased. On the basis of such material, the petitioner is in custody since 10.04.2017. The same is not controverted by the State. It appears that the petitioner is a man of clean antecedent and the investigation in the case is also complete and the charge-sheet has been submitted. Considering the aforesaid submission and the fact that similarly situated co-accused person, namely, Amit Kumar, has been granted bail vide order, dated 17.10.2017, passed in Cr. Misc. No. 45726 of 2017, the prayer for bail of the petitioner is allowed. Let the petitioner, above named, be released on bail on his furnishing bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Gopalganj, in connection with Sidhwalia P.S. Case No. 36 of 2017, subject to the conditions:
(i) That one of the bailors will be a close relative of the petitioner, who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner. (ii) That the petitioner will be well
