The petitioner seeks bail in Mohania P.S. Case No. 59/2019, instituted for offence under Section(s) 379 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that petitioner has been made accused in this case merely on suspicion.

It is alleged in the written report that on the date of occurrence informant withdrew Rs. 1 lac from SBI, Mohania Branch and was getting pass-book updated, in the meantime one person, standing near him, cut his Jhola with blade and started running away. The informant chased him and apprehended him

Learned counsel for the petitioner has submitted that there is no recovery of any incriminating article from possession of this petitioner although he was apprehended on the spot. Petitioner is in custody since 06.02.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabhua, in connection with Mohania P.S. Case No. 59/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
