Mr. A.Haque Sahara (App) ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-12-2018 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The application for anticipatory bail was filed on 23.01.2014. The Court in anticipation of restoration of good relationship between the husband and wife, granted indulgence and released the petitioner on provisional anticipatory bail vide order 24.03.2014 and direction was issued for mediation but it appears that the petitioner has not appeared before the Mediation Board and as such the mediation failed. Considering the totality of the fact situation, the Court is not inclined to grant privilege of anticipatory bail to the petitioner. The petition is, therefore, dismissed.

Patna High Court Cr.Misc. No.3911 of 2014(8) dt.10-12-2018 2/2 However, dismissal of the application for grant of anticipatory bail will not cause any prejudice to the petitioner in the event the petitioner surrenders and prays for regular bail before the court below.

The Court below is directed to dispose of the application for regular bail of the petitioner upon surrender on the same day without being influenced by the order of dismissal of his anticipatory bail application.
