Petitioner already in custody in connection with Sessions Trial No.256 of 2016, arising out of Nawanagar P.S. Case No.41 of 2016 is an accused in a case registered under Sections 447, 341, 323, 302, 120(B) and 34 of the Indian Penal Code.
Allegation in brief is that the petitioner gave repeated blow of Kata (a sharp cutting instrument) over the head of the deceased.
Submission is that this petitioner has falsely been implicated and has been in custody since 06.04.2016. However, earlier report regarding the status of the trial of the petitioner was called for and the report shows that all
Patna High Court Cr.Misc. No.50924 of 2016 (4) dt.08-03-2017 2 / 2 prosecution witnesses have been examined and the case is running for examination of defence witnesses.
As there is specific allegation of repeated Kata (a sharp cutting instrument) blow over the head of the deceased by the petitioner, the prayer for bail on behalf of the petitioner is rejected in connection with Sessions Trial No.256 of 2016, arising out of Nawanagar P.S. Case No.41 of 2016, pending before the learned Sessions Judge, Buxar.
