JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-12-2017 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Marhowrah PS case no. 438 of 2017 instituted for the offences punishable under various sections of Indian Penal Code and 30(a), 38 of the Bihar Prohibition and Excise Act, 2016. The allegation is regarding recovery of huge quantity of liquor from various places.

It is submitted by the learned counsel for the petitioner that petitioner is innocent, is in custody since 16.11.2017 and he has a fair antecedent however, subsequent to the filing of the present case, he has been remanded in three other cases on same and similar allegation.

Patna High Court Cr.Misc. No.60406 of 2017 (2) dt.21-12-2017 2/2 Considering the nature of accusation and the period of custody undergone and considering the fact that huge quantity of liquor has been recovered, I deem it fit and appropriate to direct the release of the petitioner on regular bail, however subject to furnishing bail bond of Rs. 1 lac/- (Rs. One lac) with two sureties of the like amount each to the satisfaction of Addl District & Sessions Judge 6th Saran at Chapra in connection with Marhowrah PS case no. 438 of 2017. It is further directed that the petitioner would mark his attendance before the officer-in-charge of the concerned PS at 10 am on every Monday of the week and in case of two consequent defaults, the present privilege of bail shall stand withdrawn and the petitioner shall be taken into custody forthwith.
