2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 498 (A) , 420 and 506 of the Indian Penal Code and Section 3⁄4 of the D P Act.

3. Allegation against this petitioner is of commission of torture and harassment due to non-fulfillment of demand of dowry .

4. It is submitted on behalf of the petitioner that earlier the Opposite party No. 2 has lodged a case bearing Gopalganj P . S. Case No. 2756 of 2019 under sections 498 (A)

Patna High Court CR. MISC. No.48057 of 2023(4) dt.13-12-2023 2/2 with some other allied sections of Indian Penal Code and vide order dated 18.07.2023 in Cr. Misc. No. - 36130 of 2023 this Hon'ble Court was pleased to grant anticipatory bail to the petitioner on the ground of payment of Rs. 5000/- per month . He further submits that in compliance of the order of this Hon'ble Court , petitioner is already paying monthly maintenance to the O . P . No. 2 and thereafter this false and concocted case has been lodged.

5. Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate - XVI , Gopalganj in connection with Phulwariya P.S. case No. 140 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
