The petitioner seeks bail in Chenari P.S. Case No. 174 of 2017, registered for the offences punishable under Sections 384, 386, 379, 504 and 506 of the Indian Penal Code and section 27 of the Arms Act.

Allegation against this petitioner is that petitioner along with co-accused Manish Kumar Chaubey came at the rice mill of informant and demanded Rangdari. On protest by the informant, both of them gave threat and left that place. After sometime, again both the accused persons along with two others came on motorcycle, started abusing the informant and on the point of gun snatched away Rs. 80,000/- from the box of cash counter.

Patna High Court CR. MISC. No.41002 of 2019(3) dt.20-09-2019 2/2 It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. Petitioner is innocent. In fact, co-accused sold his paddy to the informant and when the amount was demanded by the co-accused, the same was not paid to him and this false and fabricated case has been lodged. Petitioner is in custody since 14.04.2019 having no criminal antecedent. Chargesheet has already been submitted. Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 2nd, Rohtas at Sasaram in connection with Chenari P.S. Case No. 174 of 2017.
