2. The petitioner apprehends her arrest in a case registered for the offence under Sections 126(2)/115(2)/108/3(5) of the B.N.S.

3. As per F.I.R., due land dispute, the petitioner and other accused had earlier assaulted the mother-in-law of the complainant, Meenara Khatun. For which a case against the accused persons was registered. Thereafter, accused persons were putting pressure not to pursue the case. On 15.07.2024, the petitioner and other accused allegedly entered into the house of the victim, used abusive language, assaulted her and pressurized her to withdraw the case. When the victim resisted them, she was again assaulted. Thereafter,

When complainant reached home, her mother-in-law informed her that the accused abused and insulted her for withdrawing the case. Fed up with this, her mother-in-law consumed poison and was taken to the hospital where she was declared dead.

4. The learned counsel appearing on behalf of the petitioner submitted that the petitioner is innocent and has been falsely implicated in this case due to land dispute. Learned counsel for the petitioner further submits that both the parties are gotia and reside in the same building. As a matter of fact, the deceased herself committed suicide by consuming poison.

5. Learned A.P.P. for the State has opposed the bail petition and submitted that due to mental and physical harassment meted out by this petitioner, the deceased has committed suicide. As per FSL report, ENDRIN was detected in examination of viscera.

6. Considering the aforesaid facts & circumstances and the fact that the deceased was compelled to commit suicide on account of mental and physical harassment meted out by this petitioner. This application is dismissed.
