JUSTICE SUDHIR SINGH ORAL ORDER 13-01-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 406, 409, 420, 467, 468 and 120B of the Indian Penal Code.
Allegation against the petitioner is of committing irregularity in construction of residential school at Phenhara, East Champaran.
The bail application (Cr. Misc. no. 36605 of 2014) of the petitioner was earlier rejected on merit vide Annexure-1 to the present application.
It has been submitted on behalf of the petitioner that he is ready to deposit the disputed amount of Rs.56,000/- in the court below which shall be subject to the final disposal of the case. It is further submitted that other co-accused have been granted bail vide Cr. Misc. no. 21198 of 2014 and Cr. Misc. no. 17580 of 2015.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

No.56763 of 2015 (3) dt.13-01-2016 2 / 2 Considering the aforesaid facts and circumstances, it is directed that petitioner shall deposit Rs.56,000/- in the court below which shall be subject to the final disposal of the case. Let the above named petitioner, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-4, Motihari, in connection with Phenhara P.S. Case no. 24 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
