JUSTICE SANJAY PRIYA ORAL ORDER 19-02-2019 Heard learned counsel for the petitioner, learned counsel for the informant as well as learned APP for the State. The petitioner seeks bail in connection with Harlakhi P.S. Case No. 179 of 2018 instituted for the offence under Section(s) 323/341/354/307/379/504 and 34 of the Indian Penal Code.
Learned counsel for petitioner has submitted that petitioner is the Bhaisur of the informant. He has been implicated in this case due to land dispute. There is case and counter case between the parties.
Learned counsel for petitioner submits that petitioner has filed counter case vide Harlakhi P. S. Case No. 181 of 2018. It is alleged in the written report that this petitioner had attempted to outrage the modesty of the informant and on
Patna High Court Cr.Misc. No.69907 of 2018(5) dt.19-02-2019 2/2 her objection he assaulted with spade with intention to kill causing cut injury. It is further alleged that villagers arrived to save the informant then they were also assaulted by the petitioner with spade.
Case diary has been received.
Injury report of all the three injured(s) are mentioned in paragraph nos. 22 to 25 of the case diary, wherein, the doctor has found simple injuries on their persons.
Learned counsel for informant has appeared and opposed the prayer for bail.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Benipatti/ Incharge Successor Court in connection with Harlakhi P.S. Case No. 179 of 2018/ G.R. No. 671 of 2018, subject to the condition that both the bailors shall be the close relative of the petitioner.
