JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-12-2016 Heard learned counsel for the petitioner as well as learned APP for the State and learned counsel for the informant. The petitioner seeks anticipatory bail in connection with Bind P.S. Case No. 96 of 2016 instituted for the offences punishable under Sections 304(B) and 201/34 of the Indian Penal Code.

The petitioner is the father-in-law of the deceased. It has been submitted on behalf of the petitioner that the sister of the informant died due to burn injury. No specific allegation is against the petitioner and the husband of the deceased has not even named as an accused in this case rather there was no cordial relationship between the husband and the wife as she was not satisfied with her husband, due to that she committed suicide and further submission of the learned

Heard the learned APP also as well as the learned counsel for the informant.

Learned counsel for the informant has submitted that there is the allegation against the petitioner of demand of dowry and torture.

Considering the argument of both the parties, I am not inclined to grant privilege of pre-arrest bail to him and accordingly, his such prayer stands rejected in connection with Bind P.S. Case No. 96 of 2016 pending in the court of learned Additional Chief Judicial Magistrate-II, Nalanda at Biharsharif. Let the petitioner surrender before the court below and the court below will consider the submission advanced by the learned counsel of the petitioner and will pass appropriate order without being prejudiced by the order of this Court.
