JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 10-01-2023 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner has filed the instant application for grant of regular bail in connection with Raghunathpur P.S. Case No. 77 of 2022 registered under Sections 341, 323, 379, 307 and 34 of the Indian Penal Code.
Allegation against the petitioner is that he along with co-accused persons assaulted to the informant's brother and his family members due to which they sustained injury. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. It is further submitted that both parties are agnet and a land dispute going on
Patna High Court CR. MISC. No.44340 of 2022(3) dt.10-01-2023 2/2 between the parties as a result of which, petitioner has falsely been implicated in this case. Petitioner is languishing in judicial custody since 18.04.2022.
The application for bail is opposed by learned APP for the State and learned counsel for the informant. Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Raghunathpur P.S. Case No. 77 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-VIII, Siwan.
