The petitioner is apprehending his arrest in connection with Kasba P.S. Case No. 151 of 2021 pending in the Court of learned Special Excise Judge, Purnea in a case registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code and Sections 30(a) of the Bihar Prohibition and Excise Act.

It is a case of recovery of about 27.69 liters of English wine from a trunk kept in the house of the petitioner. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the petitioner has got clean antecedent. Learned APP appearing for the State has opposed the

Patna High Court CR. MISC. No.53721 of 2021(2) dt.08-04-2022 2/2 prayer for anticipatory bail.

In view of the facts that the said English wine was recovered from the trunk kept in the house of the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Prayer for anticipatory bail is rejected.
