JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-02-2016 The present application has been filed for modification of order dated 03.08.2015 passed in Cr. Misc. No. 41166 of 2014 for extending the period of surrender in which the petitioner was directed to surrender before the court below and deposit Rs. 2,75,000/-..

It is submitted by the learned counsel for the petitioner that petitioner is serving in Armed Forces, posted at Jammu Boarder and due to non-grant of leave he could not surrender or deposit the amount within time.

Considering the fact that the petitioner is serving in the Armed Forces, the order dated 03.08.2015 passed in Cr. Misc. No. 41166 of 2014 is extended that the period of surrender and deposit the above mentioned amount is extended by six weeks Considering the fact that the petitioner is serving

Patna High Court Cr.Misc. No.985 of 2016 (2) dt.03-02-2016 in Armed Forces, the period of surrender is extended by six weeks on deposit of the above mentioned amount form the date of receipt/production of a copy of this order in connection with Keshariya P.S. Case No. 83 of 2012 pending in the court of learned Chief Judicial Magistrate, Motihari.

The order dated 03.08.2015 stands modified to the extent indicated above.

Accordingly, this modification application is disposed of.
