JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 21-12-2015 The petitioner apprehends his arrest in relation to Trial No. 1173 of 2015 arising out of Rohtas Complaint Case No. 683 of 2014 registered under Sections 498A of the Indian Penal Code by his father-inlaw. Learned counsel for the petitioner submits that instead of seeking reconciliation the father-in-law has also jumped into the tray and filed the present case. The marriage had been solemnized in the year 2011 and wife of the petitioner had left the matrimonial house in the year 2012 itself, because she was not ready to look after her father-in-law and mother-in-law and wanted the
Patna High Court Cr.Misc. No.57317 of 2015 (2) dt.21-12-2015 petitioner to separate from there which was not possible. The petitioner's father-in-law also insists on the same and therefore this case has been lodged to put pressure on the petitioner.
Be that as it may, in the event of his arrest/surrender before the court below within four weeks, let the petitioner, namely, Vikash Kumar, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Sasaram (Rohtas), in connection with Trial No. 1173 of 2015 arising out of Rohtas Complaint Case No. 683 of 2014, subject to conditions laid down under Section 438 (2) of the Code of Criminal Procedure.
