The petitioner seeks bail in Hajipur Railway Protection Force Case No. 07 of 2021, registered for the offence under Section 3 of Railway Property (Unlawful Possession) Act.

As per the F.I.R., two accused persons were apprehended with (i) one flax able iron grill, (ii) one small piece iron rod, and (iii) one piece hammer and they disclosed that they were going to sale these articles in the scrap shop of petitioner. On receipt of this information, a raid was conducted in the scrap shop of petitioner and recovered some stolen iron grill as well as some pieces of railway line weighing about 80 kg. It is submitted on behalf of petitioner that no theft article was recovered from the possession of the petitioner.

Patna High Court CR. MISC. No.55889 of 2021(2) dt.07-12-2021 2/2 Petitioner has got clean antecedent and he is in custody since 26.07.2019. Chargesheet has been submitted.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances as well as period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Sonepur, Saran in connection with Hajipur R.P.F. Case No. 07 of 2021.
