2. The petitioner, who is in custody since 19.09.2015, has renewed his prayer for bail in connection with Sessions Trial No. 111 of 2016 arising out of Khagaria (Muffasil) P.S. Case no. 111 of 2015 having earlier been rejected by orders dated 23.08.2016 and 26.07.2017 in Criminal Miscellaneous No. 33142 of 2016 and Criminal Miscellaneous No. 33876 of 2017, respectively with an observation that in case the trial is not concluded within three months, the petitioner shall be at liberty to renew his prayer for bail.
3. Pursuant to the order of this Court dated 28.02.2018, status report dated 22.03.2018 has been received from the Incharge Sessions Judge, Khagaria, according to which it appears that the matter has now been fixed for prosecution evidence after examination of eleven charge sheeted witnesses.
4. Be that as it may, having regard to the entirety of the facts and circumstances of the case as well as period of custody of the petitioner above named, let him be released on bail on furnishing on furnishing bail bond of Rs. 10,000/- (ten thousand)
Patna High Court Cr.Misc. No.694 of 2018 (3) dt.04-04-2018 2/2 with two sureties of like amount each to the satisfaction of learned Sessions Judge, Khagaria in connection with Sessions Trial No. 111 of 2016 arising out of Khagaria (Muffasil) P.S. Case no. 111 of 2015 with the following conditions:
(i) That one of the bailors shall be a close relative of the petitioner.
(ii) That the petitioner shall not indulge in any similar offence till conclusion of the trial.
(iii) That the petitioner shall remain physically present in court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reason, his bail bond shall be liable to be cancelled by the learned Court concerned. (Vikash Jain, J) B.T/Chandran U T
