2. The petitioner seeks regular bail in connection with S.T. No. 354 of 2023 arising out from Nayaram Nagar P.S. Case No. 101 of 2023, registered for the offences punishable under Section 302/34 of the I.P.C. and under Section 27 of the Arms Act.
3. The prosecution case is to the effect that the brother and sister-in-law of the informant were travelling on a motorcycle when they were shot by unknown persons, and both died on account of such gunshot injuries.
4. Learned counsel for the petitioner submits that

No.54867 of 2024(6) dt.29-04-2025 2/3 the petitioner is not named in the F.I.R., and his name has transpired in the confessional statement of the co-accused, namely Rohit Kumar, who has stated that the petitioner had been giving the location of the victims. He further submits that there is no eyewitness to the occurrence, and it is merely on the statement of the co-accused, which does not have evidentiary value, that the name of the petitioner has surfaced in the present case.

Learned counsel for the petitioner further submits that similarly situated co-accused, namely Mukul Chandra Bharti @ Sumit Kumar @ Mukul Chaurasia, has been granted bail by a coordinate Bench of this Court vide order dated 05.03.2024 passed in Cr. Misc. No. 71853 of 2023. He further submits that there is no material on record to connect the petitioner with the aforesaid occurrence barring the confessional statement made by the co-accused. Lastly, it has been submitted that the petitioner has a clean antecedent and is in custody since 17.06.2023.
6. Considering the aforesaid facts and circumstances of the case and especially taking into account the fact that the petitioner's name has surfaced in the
Patna High Court CR. MISC. No.54867 of 2024(6) dt.29-04-2025 3/3 confessional statement of the co-accused and a similarly situated co-accused, namely Mukul Chandra Bharti, has been granted bail by a coordinate Bench of this Court, and also taking into consideration the clean antecedent and the period of custody undergone, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the court of learned Addl. Session Judge IV Munger, in connection with S.T. No. 354 of 2023 arising out from Nayaram Nagar P.S. Case No. 101 of 2023.
