The petitioner is accused in Dalsingsarai Police Station Case No 171 of 2017 registered for the offences punishable under Sections 392 of Indian Penal Code. Counsel for the petitioner submits that the first information report has been lodged against unknown persons alleging some loot at pistol point on the road. It is further submitted that the petitioner has been implicated in this case on the confessional statement of co-accused and that nothing has been recovered from his possession. In respect of the other cases pending against him, as mentioned in paragraph 3 of the application, it is submitted that in most of the cases, the petitioner is on bail. Patna High Court Cr.Misc. No.55426 of 2017 (3) dt.12-12-2017 2/2 has been identified in the test identification parade, has already been granted bail by this Court vide order dated 14.11.2017 passed in Cr Misc No 49414 of 2017. It is further submitted that the petitioner is in custody since 28.06.2017 and the investigation in the case is complete.

Considering the aforesaid submission, prayer for bail is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Dalsingsarai, Samastipur in Dalsingsarai Police Station Case No 171 of 2017 subject to the following conditions :

(i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
