JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-12-2015 Petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
The prosecution case is of making assault to the wife of the informant with fists, slaps and bamboo, as a result she succumbed to the injuries on the spot. It is submitted by learned counsel for the petitioner that postmortem reflects no external injury and cause of death has been opined by the doctor as cardiac arrest due to liver disease.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the accusation not being corroborated with the medical opinion and the petitioner being lady, let the petitioner, above named, in the event of her arrest
Patna High Court Cr.Misc. No.57230 of 2015 (2) dt.18-12-2015 2/2 or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Pupri at Sitamarhi in connection with Bajpatti P.S. Case No. 168 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
