The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 20 litres of country liquor was recovered from the possession of the petitioner and he was taken into custody.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the petitioner's possession. He has been falsely implicated in the case because of his antecedents. He is in custody since 11.7.2021 and chargesheet has been submitted in the case. Heard learned A.P.P. for the State.

No.53803 of 2021(2) dt.01-04-2022 2/2 Having heard learned counsel for the parties and taking into consideration the facts of the case specially the antecedents of the petitioner under the Bihar Prohibition and Excise Act, 2016 and the petitioner having been caught with liquor in his possession, the Court is not inclined to enlarge the petitioner on bail for the present and the application is rejected. Liberty is granted to the petitioner to renew his prayer for bail on completing one year in custody.
