JUSTICE SUDHIR SINGH ORAL ORDER 13-01-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 419, 420, 409, 384, 386 and 387 of the Indian Penal Code.
The prosecution case is that some unknown persons by introducing themselves forged Motor Vehicle Inspector stopped the truck of the informant and were unloading chips from the vehicle. On interference of the police, they fled away but one accused, namely, Angad was apprehended at the spot and he disclosed the name of the petitioner in confession. It is submitted on behalf of the petitioner that he has been made accused due to mistake of fact. It is further submitted that petitioner was not there at the spot when the alleged occurrence is said to have taken place. Petitioner's name has figured in the confession of co-accused, Angad Kumar Singh, who was arrested on the spot. It is further submitted that petitioner is ready to deposit an amount of Rs.10,000/- in the court below which shall be subject to the final disposal of the case. On behalf of the State, it is submitted that petitioner is named in the F.I.R.

No.56843 of 2015 (2) dt.13-01-2016 2 / 2 Considering the aforesaid facts and circumstances, it is directed that petitioner shall deposit Rs.10,000/- in the court below which shall be subject to the final disposal of the case. Let the above named petitioner, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Purnea, in connection with Mirganj P.S. Case no. 19 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
