JUSTICE RAVI RANJAN ORAL ORDER 22-01-2016 Heard learned counsel for the petitioners and the State. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 366 (A)/34 of the Indian Penal Code.

It is contended on behalf of the petitioners that the statement of the victim girl has been recorded under Section 164 Cr.P.C. in which she has stated that her brother-in-law (Jija Ji), namely, Santosh Yadav, had forcibly taken her away and kept her with him. The petitioner no.1 being the elder brother of the coaccused Santosh Yadav and the petitioner no.2 being mother of the co-accused Sanstoh Yadav have not been named by the victim girl in her statement.

No.57602 of 2015 (2) dt.22-01-2016 2/2 Having regard to the facts and circumstances of the case, let the petitioners, namely, Anil Yadav and Daizy Bhushan Devi be released on bail in the event of their arrest/surrender before the court below within a period of six weeks from today in connection with Tribeniganj P.S. Case No.154/2015, on furnishing bail bonds of Rs.10,000 (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Supaul subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
