JUSTICE ARUN KUMAR ORAL ORDER 20-12-2017 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Sheikhpura PS Case No. 11 of 2014 registered under Sections 120B and 414 of the IPC.

The allegation in brief is that three motorcycles were recovered in this case; one from the possession of Siri Mahto and another in front of the shop of Ganesh Vishwakarma another coaccused and the third one in an abandoned condition by the side of the road and the petitioner is alleged to be the gang leader of committing theft of motorcycle.

Learned Counsel for the petitioner submits that nothing has been recovered from the possession of the petitioner, only it is alleged that one motorcycle was used by this petitioner, petitioner is in custody since 4.9.2017 and the police has submitted charge sheet. Having considered the said facts and circumstances, the petitioner, namely, Guddu Kumar @ Guddu Mahto is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Sheikhpura in connection with Sheikhpura PS

Patna High Court Cr.Misc. No.61295 of 2017 (2) dt.20-12-2017 Case No. 11 of 2014, with the condition that one of the bailors must be father or mother of the petitioner. The petitioner is directed to be present before the trial court on each date fixed in the case and in case of his absence on two consecutive dates his bail bonds shall be liable to be cancelled.
