The petitioner seeks bail in Bounsi P.S. Case No. 217 of 2017 registered under Sections 25(1-b)a, 26 and 35 of the Arms Act.

One loaded country made pistol is said to have been recovered from the possession of the petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. Other accused persons from whose possession cartridge was recovered have been enlarged on bail by this court. The petitioner has been languishing in custody since 01.09.2017.

In the facts and circumstances of the case, I am not

Patna High Court Cr.Misc. No.53639 of 2017 (2) dt.09-11-2017 2/2 inclined to enlarge the petitioner on bail at this stage. Prayer for bail of the petitioner is rejected.

However, the petitioner may renew his prayer for bail after four months or framing of charge whichever happens earlier.
