JUSTICE BIRENDRA KUMAR ORAL ORDER 03-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 409 of the Indian Penal Code.

Allegation against the petitioner is that while he was working as Circle Officer, Uda-Kishunganj, he purchased the disputed land of Rs.4,50,000/- under a government scheme for rehabilitation of Scheduled Castes members of the society. Submission of the petitioner is that the petitioner has already been removed from the service and he bonafidely purchased the land from a recorded landlord without knowledge that the said land is under dispute.

No.43482 of 2016 (4) dt.03-03-2017 2/2 Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Madhepura/Successor Court in connection with UdaKishunganj Police Station Case No. 96 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
