28-01-2022 Heard learned counsel for the parties through video conferencing.

The petitioner seeks bail in Tajpur P.S. Case No. 145 of 2021, registered for the offence under Sections 394, 395, 397, 398 of the Indian Penal Code.

As per the First Information Report, three unknown miscreants riding on a motorcycle, fired on the informant causing injury and snatched gold ornaments, silver, cash and mobile phone of the informant and thereafter, fled away. Learned counsel for the petitioner submits that name of petitioner has transpired during course of investigation. No looted article has been recovered from possession of petitioner and till date, petitioner has not been put on T.I.P. Only material, which has come against the petitioner, is that the mobile tower

Patna High Court CR. MISC. No.53917 of 2021(2) dt.28-01-2022 2/2 location of petitioner was found at that very time at the place of occurrence and he was in contact with co-accused Nitesh Kumar, from whose possession, looted mobile of informant was recovered. Save and except this, there is no other material against this petitioner to show his complicity in the aforesaid crime and he is in custody since 13.07.2021. Investigation is complete.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - I, Samastipur in connection with Tajpur (Halai O.P.)
