2. The petitioners seek bail in connection with Naya Bhojpur P.S. Case No. 31 of 2025 registered for the offence punishable under Sections 103(1) and 3(5) of the Bharatiya Nyaya Sanhita.
3. For a trivial dispute, the accused persons are alleged to have assaulted the victim by fists and slaps due to which the deceased died.
4. The petitioner is in custody since 20.03.2025.
5. Learned counsel for the petitioners submits that no
Patna High Court CR. MISC. No. 43946 of 2025(5) dt.15-10-2025 2/2 offence under Section 103 of the BNS is made out as the mens rea is apparently absent.
6. Learned APP appearing for the State opposes the prayer for regular bail of the petitioners.
7. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar/ concerned Court in connection with Naya Bhojpur P.S.
