Petitioners apprehend arrest in a case registered for the offence punishable under Sections 3, 17(1), 18(2) of Pre-Conception and Pre-Natal Diagnostic Techniques Act, 1994. As per prosecution case, these petitioners were running pathological lab without having any license. Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in this case. It is next submitted that petitioners have already applied for license and the lab was closed at the time when raid was conducted and as such, he has committed no offence.

Considering the aforesaid facts and circumstances, let the above named petitioners in the event of their arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in Govt.
