JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-03-2016 The present modification application has been filed for modification of the order dated 16.10.2015, passed in Criminal Miscellaneous No. 33967 of 2015. Though, the earlier order was passed by a co-ordinate Bench of this Court, but since the concerned Bench is not available due to medical exigency, the matter has been placed under the heading 'For Admission' before this Court in view of the administrative order of Hon'ble the Acting Chief Justice dated 17.03.2016, which gets reflected from the mention slip at Flag- 'A'.
Earlier the petitioner was granted anticipatory bail in Karakat P.S. Case No. 64 of 2015 with a condition to deposit 20 percent of the alleged due amount of Rs. 27,53,258.17 within a period of eight months when the petitioner was supposed to surrender and execute bail bonds within a period of four weeks from the date of receipt/production of copy of that order but the
Patna High Court Cr.Misc. No.1699 of 2016 (2) dt.18-03-2016 2/2 petitioner could not furnish the bail bonds within the stipulated time.
It is submitted by learned counsel for the petitoenr that the petitioner confines his prayer only to the extent of extending the period of surrender.
On the ground mentioned in the modification application, period of surrender is extended by two weeks from the date of receipt/production of copy of this order in connection with Karakat P.S. Case No. 64 of 2015.
Rest of the condition as stipulated in the order dated 16.10.2015, passed in Criminal Miscellaneous No. 33967 of 2015.will remain same.
