2. The petitioner has prayed for bail in connection with POCSO Case No. 14 of 2025 arising out of Sikraul P.S. Case No. 133 of 2024 registered for the offence punishable under Section 96 of the B.N.S., 2023 and Section 8 and 12 of the POCSO Act.
3. The case of the prosecution, in short, is that the petitioner has kidnapped the minor daughter of the informant.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this

During the course of investigation, the victim was recovered and she has given her statement recorded under Sections 180 and 183 of the BNSS. In her statement u/s 180 of the BNSS, she has stated that while she was staying at Buxar, the petitioner was having an eye on her and was teasing her. When her father came to know she was taken to village. It is further submitted that the petitioner enticed her and took her to Haryana. In her statement recorded under Section 183 of the BNSS, she has developed the story and has stated that she was taken by the petitioner to various places and that he has established forceful physical relationship with her twice. From perusal of the medical examination report, it will transpire that the doctors have not found any mark or injury on any part of the body and have opined that there is no sign of recent sexual act.
5. The application for bail is vehemently opposed by the learned counsel for the informant and the learned APP for the State. Learned counsel for the informant has stated that during the trial, all witnesses have been examined and only the school register has been called by the learned trial court and the trial is at its fag end.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is
Patna High Court CR. MISC. No.44962 of 2025(6) dt.10-03-2026 3/3 not inclined to enlarge the petitioner on bail at this stage. However, the petitioner will be at liberty to renew his prayer for bail after three months, if the trial is not concluded.
7. Accordingly, the present bail application of the petitioner is hereby rejected.
