JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-12-2017 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners seek regular bail in connection with Mufassil P. S. Case No. 344 of 2017 instituted for the offence punishable under Section 30 (a) of the Bihar Excise Prohibition Amendment Act, 2016.
The allegation is regarding recovery of 54.18 liters of illicit liquor from the house of the petitioners, who are husband and wife.
Learned counsel for the petitioners submits that in fact they have been falsely implicated in the present case and they have clean antecedent. It is stated that the petitioners are languishing in
Patna High Court Cr.Misc. No.59085 of 2017 (2) dt.22-12-2017 2/2 custody since 06.11.2017.
Considering the nature of accusation, period of custody undergone and clean antecedent, I deem it fit and appropriate to direct the release of the petitioners. Accordingly, the petitioners are directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Gaya in connection with Mufassil P.S.Case No. 344 of 2017.
