JUSTICE ARUN KUMAR ORAL ORDER 10-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Bhagwanpur PS Case No. 222 of 2016 (Sessions Trial No. 488 of 2017) registered under Sections 302, 120B/34 of the IPC and under Section 27 of the Arms Act.
The allegation in brief is that the petitioner called son of the informant from the premises of Yajna ceremony, took him to the nearby orchard, where other accused persons caught him and Satyam shot at him causing his death. It is alleged that the accused persons have committed the offence after hatching criminal conspiracy with Rajesh Kumar Singh.
Learned Counsel for the petitioner submits that the allegation against the petitioner is of calling the deceased from the Yajna place, there is no allegation of assault by the petitioner or opening fire, the allegation of killing is against Satyam Kumar, grand-son of the petitioner so on that account the grand-father has also been implicated in this case. The petitioner has no criminal antecedent, he is 70 years old man and a Homeopathic doctor. He is in custody since 18.4.2017 and charge has been framed in this case.

No.62479 of 2017 (2) dt.10-01-2018 Having considered the said facts and circumstances, the petitioner, namely, Ramashish Rai is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge, VI, Begusarai in connection with Bhagwanpur PS Case No. 222 of 2016 (S.Tr.
