JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 03-01-2019 Heard learned Counsel for the parties concerned. The petitioner is seeking direction to the State respondents to return the possession of land appertaining to Khesra No. 2527, Khata No. 57, ad-measuring 161⁄2 decimals of land, situated in notified area, under Thakurganj Municipality, in the district of Kishanganj.

It is the case of the petitioner that the said land has been acquired by the Agricultural Marketing Board, Patna, for the purpose of Agricultural Marketing Yard and though the said land was not notified in the Bihar Gazette, yet for the purpose of acquisition, the respondents have acquired possession, without notice and without paying compensation.

Learned Counsel appearing on behalf of the petitioner has submitted that purpose of the petitioner shall be served if the

Patna High Court CWJC No.6164 of 2008(5) dt.03-01-2019 2/2 District Magistrate, Kishanganj, is asked to examine the petitioner's case and take a final decision.

Considering the submission, as advanced on behalf of the petitioner, this application is disposed of with the observation that if the petitioner approaches the District Magistrate, Kishanganj, by way of representation, within a period of four weeks from today, the District Magistrate shall examine and communicate to the petitioner the view of the Revenue Authorities in this regard in respect of the land in question within a period of two months thereafter. The application stands disposed of.
