JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,324 and 504/34 of the Indian Penal Code and section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.
The prosecution case is that for a dispute with regard to fixing electric pole, the accused persons came variously armed and assaulted the informant, his father and grand mother. It is alleged against the petitioner that he assaulted the grand mother of the informant Reshma Devi with sword.
It is submitted by the learned counsel for the petitioner that there is counter version of the occurrence and the petitioner
Patna High Court Cr.Misc. No.187 of 2016 (2) dt.06-01-2016 2/2 side also received injuries. More over, Reshma Devi has received one laceration and one abrasion injury of marginal size caused by hard and blunt substance whereas it is alleged that the petitioner made assault with sword.
Considering the genesis of the occurrence and the accusation being not corroborated with the medical opinion, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Gopalganj in connection with Uchkagaon P.S. Case No.135 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
