The petitioner has preferred this application for grant of regular bail in a case registered under sections 279, 427, 429, 295A and 34 of the Indian Penal Code and section 11(i) of the Prevention of Cruelty to Animal Act, 1960.

As per the prosecution case, two persons on a motorcycle dashed against the car of the informant. On being questioned, it is stated that the accused persons escaped leaving behind a bag which on opening, it transpired that the same contained 60 kgs of beef.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No incriminating article has been recovered from his possession. The petitioner is in custody since 24.6.2021 and has no criminal

Having heard learned counsel for the parties and taking into consideration the nature of allegation, the petitioner having remained in custody for 9 months and not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Paharpur (Malahi) P.S. Case no. 462 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 11th Additional Chief Judicial Magistrate, Motihari, East Champaran.
