JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-12-2017 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Chand P.S. Case No.253 of 2017 instituted for the offences under Section 20(ii), (b), 20(b), 21, 27-A of the N.D.P.S. Act and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The allegation is regarding recovery of English wine and 4.7 kg. of ganja from the house of one Shahabuddin Ansari. The learned counsel for the petitioner submits that the petitioner was not apprehended from the spot and as far as the seizure list is concerned, no recovery has been effected from his conscious possession. The petitioner is languishing in custody
Patna High Court Cr.Misc. No.60870 of 2017 (2) dt.21-12-2017 2/2 since 09.11.2017 and as far as his antecedent is concerned, he is accused in one another case on similar and same accusation. Considering the nature of accusation and the period of custody already undergone as also the fact that admittedly no ganja has been recovered from the petitioner, I deem it proper to enlarge the petitioner on bail. Accordingly, the petitioner named above is directed to be released on regular bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge-cumADJ-Ivth, Kaimur at Bhabua in connection with Chand P.S. Case No.253 of 2017.
