2. The petitioner is in custody since 27.12.2018 in connection with Nadi Thana P.S. Case No. 269 of 2018, Special Case No. 148 of 2018 for the offences alleged under Sections 20/22/25/29 of NDPS Act and Sections 120B and 34 of the Indian Penal Code.
3. It is submitted that the petitioner has been falsely implicated in connection with recovery of about 562 Kgs. of ganja from truck no. PB08DS-4978 which was intercepted on way from Kachchi Dargar to Raghopur, Vaishali. The petitioner is the driver of the said truck and was arrested at the spot but however he had no knowledge about the contents and goods being transported as he merely received Rs. 10,000/- as remuneration
Patna High Court CR. MISC. No.42746 of 2019(6) dt.20-11-2019 2/2 on each delivery. The petitioner is not the owner of the truck nor has any concern with the recovered ganja. The petitioner has already suffered about one year in custody since his arrest on 27.12.2018. The petitioner claims clean antecedents.
4. Learned APP appears and submits on the basis of case diary that the petitioner has been arrested from the spot and was the driver of the truck from which recovery of the huge quantity of ganja has been made.
5. Having regard to the nature of accusations and the gravity of the offence alleged, this Court is not inclined to grant the privilege of bail to the petitioner. The petition stands dismissed.
