The petitioner apprehends her arrest in Kadamkuan P.S. Case No. 225/2015, registered for the offences punishable under Sections 304B, 201 and 34 of the Indian Penal Code and Section 3 and 4 of the Dowry Prohibition Act.
The informant alleged that his sister was married in February, 2013 with Santosh Kumar Gupta of Daldali Road, Bakarganj, Kadamkuan, but her husband, father-in-law, motherin-law, grandmother-in-law (petitioner) and others were torturing her for demand of dowry. On 26.05.2015 the informant had talk with his sister, but on the next day father-in-law Ashok Kumar Gupta informed the informant that his sister died. Learned counsel for the petitioner submits that petitioner
Patna High Court Cr.Misc. No.39696 of 2016 (2) dt.19-09-2016 2/2 is a lady and happens to be the grandmother-in-law of the deceased. She has falsely been implicated in this case, although she has no manner of concern with the family affairs of the deceased and her husband.
Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that petitioner is the grandmother-in-law of the deceased, the petitioner abovenamed, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate Ist Class, Patna in connection with Kadamkuan P.S. Case No. 225/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
